Terms and conditions
These terms apply to bookings made with Marc McAdam trading as Foxy Photo Booth.

These terms should be read alongside your booking summary, invoice and any written quotation or confirmation. Where a booking-specific document contains a different agreed term, that booking-specific term will apply.
1. Booking and confirmation
A date is not reserved until the required booking payment has been received and Foxy Photo Booth has issued confirmation. Availability shown online can change until payment is completed.
The standard booking payment is normally £100, although a different amount may apply to bespoke, corporate, multi-day or higher-value bookings. The amount due will be shown before payment.
2. Balance payments
Unless otherwise stated in writing, the remaining balance is due 30 days before the event. Bookings made within 30 days of the event may require payment in full at the time of booking.
If a payment remains overdue after reminders, Foxy Photo Booth may cancel the booking and release the date. Where the booking system gives a payment deadline, the booking may be released if payment is not completed within that period.
3. Cancellations and changes by the customer
Please notify Foxy Photo Booth in writing as soon as possible if you need to cancel, postpone or change your booking. The initial booking payment is used to reserve the date and cover administration and preparation. Any refund or further amount due following cancellation will be determined by the booking-specific cancellation terms shown when you booked.
Date changes are subject to availability and are not guaranteed. Changes to venue, operating times, equipment, package or access arrangements may affect the price.
4. Access, setup and venue requirements
The customer is responsible for obtaining the venue's permission and ensuring suitable access, space and power are available. Foxy Photo Booth normally arrives around one hour before the booked start time. Larger, branded or bespoke installations may require earlier access.
Equipment must be positioned on a safe, level and stable surface with reasonable protection from weather, excessive heat, water and interference. Outdoor operation is only possible where suitable cover, power and ground conditions have been agreed in advance.
The customer must tell Foxy Photo Booth about stairs, restricted access, parking restrictions, loading rules, long carry distances or any other access issue before the event.
5. Hire period and operation
The service will operate during the times stated in the booking confirmation. Delays caused by late venue access, room changes, speeches, meals or other circumstances outside Foxy Photo Booth's control do not automatically extend the hire period.
Reasonable breaks may be required for media changes, maintenance or safety. Foxy Photo Booth may temporarily pause or stop operation where guests, venue conditions or equipment safety make continued use unsafe.
6. Equipment and substitutions
Foxy Photo Booth will make reasonable efforts to provide the equipment and service booked. Where equipment becomes unavailable because of damage, breakdown or circumstances outside reasonable control, an equivalent or suitable alternative may be supplied where possible.
Minor differences in booth finish, props, screens, print colour or layout may occur because of equipment, lighting, stock or venue conditions.
7. Prints and digital files
The number and format of prints, digital files and sharing options are determined by the package selected. Unlimited use means guests may use the booth throughout the booked operating period; it does not guarantee that every guest will be photographed or receive a print.
Digital delivery and online sharing depend on working internet services, mobile networks and third-party platforms. Where connectivity is unavailable, files may be delivered or uploaded after the event.
8. Customer and guest conduct
The customer is responsible for the reasonable behaviour of guests using the equipment. Foxy Photo Booth may refuse service to anyone who is abusive, intoxicated to the point of creating risk, or likely to damage equipment or injure another person.
The customer may be responsible for the reasonable cost of repairing or replacing equipment deliberately or negligently damaged by the customer or their guests.
9. Images, recordings and privacy
Images, videos and audio recordings are created for the customer and their guests as part of the booked service. Guests should not use the service to create unlawful, abusive or inappropriate content.
Foxy Photo Booth will not use identifiable event content for public marketing without an appropriate basis or permission. Files may be retained for a reasonable period to provide the service, resolve technical issues and fulfil the booking.
10. Technical failure and liability
Foxy Photo Booth will take reasonable care in supplying the service. If a significant technical failure occurs, the appropriate remedy will depend on the length and effect of the interruption and may include a proportionate refund.
Foxy Photo Booth is not responsible for indirect or consequential loss, loss of profit, venue failures, internet outages or events outside reasonable control. Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence or for fraud.
11. Events outside reasonable control
Neither party will be responsible for failure caused by events outside reasonable control, including severe weather, road closure, venue closure, power failure, government restriction, serious illness, accident or transport breakdown. The parties will try to agree a reasonable alternative where possible.
12. Complaints
Please raise any issue with the attendant during the event where possible so that it can be addressed immediately. Any complaint after the event should be sent promptly through the contact page with the booking name, date and details of the issue.
13. General
If any part of these terms is found unenforceable, the remaining terms will continue to apply. No failure or delay in enforcing a right will waive that right. These terms are governed by the law of Scotland, and any dispute will be subject to the jurisdiction of the Scottish courts, without affecting any mandatory consumer rights.
